2018 LABATT BLUE LOVING NEW YORK CORNHOLE CHAMPIONSHIP

Welcome to the 2018 Labatt Blue Loving New York Cornhole Championship (the “Tournament”.)

The Tournament is a series of games of skill designed to test your ability in playing a cornhole bean bag toss game. The Tournament will be conducted in 7 different cities/market in New York State. The Tournament is provided solely for entertainment purposes and is not for gambling purposes. Any gambling related to the Tournament will not be tolerated, and any Contestant determined by the Tournament Administrators to have engaged in gambling relating to the Tournament, will be immediately disqualified from the Tournament.

The participating cities/markets are:

Rochester

Binghamton

Syracuse

Elmira/Corning/Horsehead/Ithaca/CortIand

Oswego/Watertown/A-Bay

Saratoga/Glen Falls

Albany/Troy

The Tournament begins on or around June 26, 2018 and ends on or around September 3, 2018. The Tournament Finals will take place in Syracuse, New York between on or around September 3, 2018. (Actual date of Tournament Finals to be decided in the sole discretion of the Sponsor.)

  • The Tournament is sponsored by Labatt USA (“Sponsor”) and conducted and administered by Townsquare Media Albany, Townsquare Media Binghamton, Cayuga Radio Group, Community Broadcasters, LLC, Equinox Broadcasting, Cumulus Radio Station Group Syracuse, and I Heart Media Rochester (the “Tournament Administrators”). The decisions of the Tournament Administrators are final and binding in all matters as they relate to the Tournament.
    1. The Tournament is open to legal US residents of New York, who are 21 years of age and older at the time of registration.
    2. The Tournament is not open to employees and representatives of Labatt USA, Townsquare Media Albany, Townsquare Media Binghamton, Cayuga Radio Group, Community Broadcasters, LLC, Equinox Broadcasting, Cumulus Radio Station Group Syracuse, and I Heart Media Rochester, including their respective subsidiaries, sponsors, promotional agencies and members of the immediate families of such employees or representatives and persons with whom such employees and representatives are domiciled. An “immediate family” is defined as parent, child, sibling or any person residing in the same household as, or domiciled with, any such employee or representative.
    3. The Tournament is void where prohibited by law or where licensing is required.
    4. As used in these Rules, Entrants may be referred to as “Entrant,” “Contestant,” “Player,” or “you.
  • The Tournament will feature up to eight (8) qualifying events to take place in participating venues in each of the seven (7) identified cities/markets for a total of up to fifty-six (56) qualifying events (“Qualifying Round”). Two (2) winners from each qualifying event will advance to the regional final event located in the corresponding city/market, for a total of seven (7) regional final events (“Regional Final”). The top two (2) teams from each Regional Final will advance to the State final event (“State Finals”),
  • There are two ways in which a team may play the State Finals: (i) advance from the Qualifying Round to the Regional Finals held at a participating venue during the period of June 26, 2018 and August 31 , 2018, or (ii) register for one of the thirty-two (32) last chance entry spots at the State Finals. The thirty-two (32) last chance entry spots will be awarded on a first come-first serve basis on the day of the Tournament Finals. There is an entry fee of $10.00 per team regardless if entry is in the Qualifying Round or in the last chance entry at the State Finals.
  • Qualifying Rounds
    1. Contestants can register for a Qualifying Round at a Tournament venue (“Tournament Venue”) within any of the seven (7) participating cities/markets.
    2. All Contestants must be 21 years of age or older at the time of registration and proof of age and residency may be required as a condition of registration.
  1. Each Entrant will be part of a 2-person team (Entrant Team). The Entrant Team is the individuals whose names appears on the Entry submission. The Entrant Team are the only persons eligible to receive any prize with respect to the Entry. There is an entry fee of $10.00 per Entrant Team.
  2. Contestants may enter at one or more Tournament Venue. However, once an Entrant Team is declared the winner of a Tournament Venue (“Venue Winner”), each member of the Entrant Team is excluded from play in remaining Qualifying Rounds.
  3. Registration begins approximately 45 minutes prior to the commencement of the Qualifying Round and will end approximately 15 minutes prior to commencement of the first game. There is no predetermined maximum number of Entrant Teams allowed to register for the Tournament per Tournament Venue, however, in the event of a high number of Entrant Teams, it will be in the sole discretion of the Tournament Administrators to place a limit on the number of Entrant Teams allowed per Tournament Venue.
  4. Entrant Teams will be randomly placed in a Tournament bracket at the Tournament Venue.
  5. Upon collecting all registrations, the Qualifying Round will begin.
  6. Play will continue in a series of single elimination games until a winning team for that Tournament Venue is declared.
  7. Entrant Teams are expected to be prepared to play when scheduled and may be required to show proof of identification prior to play. Any Entrant Team not prepared to play when required may, in the discretion of the Tournament Administrators, either (i) lose his/her slot and play at a later time during the Qualifying Round or, (ii) be disqualified.
    1. If an Entrant Team is not present at a scheduled start-time, the Tournament Administrators will move to the next scheduled game and re-call the missing Entrant Team’s name at least 2 times thereafter. After 2 failed attempts to locate a missing Entrant Team, that Entrant Team will be disqualified and the opponent will be declared the winner of that game, Implementation of this rule is at the discretion of the Tournament Administrators.
    2. All Contestants are expected to remain at the Tournament Venue and be prepared to play until eliminated from the Tournament.
  • Regional Finals.
    1. Each Venue Winner and runner up will advance to compete in the Regional Finals located in his/her corresponding city/market on a date, time and location to be determined by the Tournament Administrators. Each Venue Winner and runner up will be provided with information as to where the Regional Finals are scheduled and an approximate time of play.
    2. The Regional Finals will consist of up to sixteen (16) teams in each of the seven (7) participating cities/markets (“Regional Participants”). All Regional Participants will be entered in to a bracket at random within his/her city/market.
    3. Regional Participants are expected to be at the location of the Regional Finals 30 minutes prior to commencement of the first game and is expected to remain at the Regional Finals until eliminated from the Tournament.
    4. Any Regional Participant not prepared to play when required may, in the discretion of the Tournament Administrators, either (i) lose his/her slot and play at a later time during the Regional Finals or, (ii) be disqualified. Disqualification of one member of a team results in disqualification of the entire team.
      1. If a Regional Participant is not present at a scheduled start-time, the Tournament Administrators will move to the next scheduled game and re-call the missing Regional Participant’s name at least 2 times thereafter. After 2 failed attempts to locate a missing Regional Participant, that Regional Participant will be disqualified and the opponent will be declared the winner of that game. Implementation of this rule is at the discretion of the Tournament Administrators.
    5. Play will continue in a series of best of three (3) games until a winning team (“Regional Winners”) and a runner up (“Regional Runner Up”) for that city/market are determined.
  • State Finals.
    1. Regional Winners and Regional Runner Ups from all seven (7) cities/markets will advance to compete in the State Finals on September 1 st 2 nd or 3 rd of 2018 (actual date to be selected at Sponsor’s sole discretion) at the New York State Fairgrounds located in Syracuse, New York at a time to be determined solely by the Tournament Administrators. All Regional Winners and Regional Runner Ups will be provided with information as to the approximate date and time of play.
    2. The State Finals will consist of sixteen (16) teams (“Final Participants”) including fourteen (14) Regional Winners and Regional Runner Ups and two (2) teams to be selected at the State Finals on a first-come, first serve basis. All Final Participants will be entered in to a bracket at random.
    3. Final Participants are expected to be at the location of the State Finals 30 minutes prior to commencement of the first game and is expected to remain at the State Finals until eliminated from the Tournament.
    4. Final Participants are expected to be prepared to play when scheduled, and may be required to show proof of identification prior to play.
    5. Any Final Participants not prepared to play when required may, in the discretion of the Tournament Administrators, either (i) lose his/her slot and play at a later time during the State Finals or, (ii) be disqualified. Disqualification of one member of a team results in disqualification of the entire team.
    6. i) If a Final Participant is not present at a scheduled start-time, the Tournament Administrators will move to the next scheduled game and re-call the missing Final Participant’s name at least 2 times thereafter. After 2 failed attempts to locate a missing Final Participants, that Final Participants will be disqualified and the opponent will be declared the winner of that game. Implementation of this rule is at the discretion of the Tournament Administrators,
    7. Play will continue in a series of best of three (3) games until the first, second, and third place teams are determined (“Tournament Winners”).
    1. Each Tournament Venue will have at least four (4) boards and the total number of Entrant Teams will vary from location to location.
    2. The Tournament Administrators, in their sole discretion, will appoint Officials to referee each game.
    3. An attempt will be made to be as flexible as possible to accommodate play but the Tournament Administrators and Officials reserve the right to take whatever actions appropriate to move games along.
    4. Player brackets will be posted at the site with estimated start times for each round. Due to the sudden-death style of play, there is no guarantee as to when any particular game will start or end.
    5. All games will follow the Officiat American Cornhole Organization Rules of Play, See Appendix A. In the event that there is a discrepancy that falls outside the scope of the Official American Cornhole Organization Rules of Play, it will be within the sole discretion of the Tournament Administrators and/or the appointed Officials to make a determine the outcome of said discrepancy. All decisions of Tournament Administrators and Officials are final and binding.
    1. Subject to confirmation of eligibility, the Regional Winners will receive the following:
      1. First Place: The Entrant Team to place first in his/her region will be awarded $200.00 and entry to the New York State Fairgrounds to participate in the State Finals.
      2. Second Place: The Entrant Team to place second in his/her region will be awarded $100.00 and entry to the New York State Fairgrounds to participate in the State Finals.
    2. Subject to confirmation of eligibility, the Tournament Winners will receive the following:
      1. First Place: The Entrant Team declared to be the overall winner of the Tournament will receive $1 ,000.00.
      2. Second Place: The Entrant Team declared to be the runner up will receive $500.00
    3. First and Second place prizes of both the Regional Finals and State Finals may collectively be referred to herein as “Prize” or “Prizes”
    4. First and Second place winners of the Regional Finals and the State Finals may herein be referred to as “Winner”.
    5. Any and all other costs and expenses not specifically mentioned herein including, but not limited to, transportation, parking, tolls, amenities, fuel, hotel, meals, beverages, room service, upgrades, all taxes, insurance, and personal expenses, are each Winner’s responsibility to pay. Taxes (federal, state, and local) are the sole responsibility of the Winner. Sponsor and Tournament

Administrators do not provide tax advice. Participants and Winners are encouraged to contact their own advisor regarding potential tax implications, if any, of this contest.

  1. Components of a Prize, if any, are to be used at the same time and no refunds or value will be provided if any component of a Prize is not or cannot be used, or is otherwise declined. In the event there is any difference between the actual value of a Prize and the ARV, no refund for any difference will be provided. No alcohol is being awarded as a prize.
  2. The Approximate Retail value (“ARV”) of all Prizes is $3,880.00
  3. It will be the responsibility for the Tournament Administrators and/or Officials to collect all entry fees and distribute Prizes.
    1. The Tournament Administrators and or Officials reserve the right at any time to disqualify any Contestant from the Tournament for exhibiting unruly behavior, disruptive behavior, unsportsmanlike behavior, cheating, and/or any other conduct deemed inappropriate by Tournament Administrators in their sole discretion.
    2. The names and address (city and state) of all prize winners will be posted online following the Tournament.
    3. Each prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release and return same, properly executed, within the time specified by the Tournament Administrators. All federal, state and other taxes are the responsibility of each individual prize winner. A prize winner must provide his/her social security number and will be issued an IRS Form 1099 for prizes valued in excess of $600.00.
    4. Entry into the Tournament constitutes permission for the Sponsor and Tournament Administrators to use the Contestant’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for publicity and promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation.
    5. By participating, Contestants agree to be bound by these Official Rules and the decisions of the Tournament Administrators and waive any right to claim ambiguity with regard to the interpretation of the Official Rules.
    6. In the absence of a Tournament Administrator at any game, the Official assigned to a game will be the final decision-maker relating to any and all disputes occurring during such game and such decisions will be final. At any time, a Tournament Administrator present at a game may delegate his/her authority or responsibility to resolve disputes during such game to an Official, and the decisions of such Official shall be final.
    7. All Contestants, as a specific condition of participation in the Tournament, agree to release, discharge, indemnify and hold harmless Sponsor and their respective affiliates and directors, officers, employees and agents, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use, or enjoyment of any prize awarded in the Tournament or from participation in the Tournament.
    8. All Contestants, as a specific condition of participation in the Tournament, agree to release, discharge, indemnify and hold harmless the Tournament Administrators and their respective affiliates and directors, officers, employees and agents, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use, or enjoyment of any prize awarded in the Tournament or from participation in the Tournament.
    9. The Tournament is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the logistics of the Tournament will be disqualified The Tournament Administrators are not responsible for any incorrect or inaccurate information, whether caused by any printing, technical or human error which may occU( during the Tournament. Tournament Administrators assume no responsibility for any error, omission, interruption, deletion, defect, or delay with regard to the Tournament. The Tournament Administrators are not responsible or liable for any loss, damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, transportation carriers and any person providing any service or accommodation in conjunction with any component of a Prize awarded, or for delays and cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, or Acts of God.
    10. Any litigation commenced as a result or consequence of participation in the Tournament shall be governed by New York law and resolved in courts sitting in Erie County, New York. Any judgment or award in favor of a Contestant shall be limited to such Contestant’s actual out-of-pocket costs incurred to participate in the Tournament and, in no event, shall include attorney fees. All Entrants waive any claims to the Tournament Administrators for punitive, incidental and consequential damages. BY PARTICIPATING, EACH CONTESTANT UNDERSTANDS AND AGREES THAT HE/SHE MAY BRING A CLAIM AGAINST THE TOURNAMENT ADMINISTRATORS ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
    11. With regard to any prize awarded, the Tournament Administrators make no express or implied warranty of merchantability or fitness for a particular purpose.

The Tournament is void where prohibited.

  1. The Sponsor and/or Tournament Administrators at all times have the right to cancel or suspend all or part of the Tournament, for any reason, in their sole discretion.
  2. Personal information provided to participate in this contest is subject to the Labatt USA Operating Co, LLC Privacy Policy found at www.nabreweries.com/privacy.
  3. If for any reason a Winner cannot travel to or attend the Regional Finals and/or the State Finals, that person may, in the sole discretion of the Tournament Administrators, be disqualified from the Tournament and will not be eligible for any Prize.
