Police have charged the driver of the truck in the Simeon’s crash with “unreasonable speed,” according to Ronna J. Collins, chief clerk with the Ithaca City Court.
The charge was filed against Viacheslav Grychanyi on Feb. 18, according to Collins. He was driving anywhere between 40 and 50 mph at the time of the crash.
Additionally, both city court judges have recused themselves from the case.
Before becoming a judge, Scott Miller belonged to a law firm that represented Simeon’s, Collins said. Rick Wallace, who has served on the court for less than a year, ran a law firm that represents the estate of Amanda Bush, the Simeon’s bartender who was killed in the crash.
Now, the case will be transferred to another court, a decision that will be made by officials with the Tompkins County Court system.
Following the crash, Grychanyi had been ticketed for having inadequate brakes and driving an “over-length” vehicle.
