GROTON — State Police say they won’t be filing charges against a man who struck a pedestrian with his car on Route 38 this week.

Police say the accident happened Wednesday night near the intersection of Stevens Road. They say their investigation has revealed that 39-year-old Robert Pless of Groton was walking in the middle of the northbound lane when he was hit by the car.

Police say the accident was unavoidable and the driver wasn’t at fault. Pless is still listed in critical condition at a Syracuse hospital.
